Rebecca has extensive experience of litigating patents across the full range of Courts and tribunals, from the UK IP Office, IP Enterprise Court, High Court and Court of Appeal to the Supreme Court and the Court of Justice of the European Union. She has considerable experience of co-ordinating multi-jurisdictional litigation in patent validity, infringement and entitlement actions, and of opposition proceedings before the European Patent Office. She also advises on freedom to operate, providing opinions on patent validity and infringement.
Rebecca’s background in biological sciences enables her to get deep into technical patent issues and provide comprehensive advice in the life sciences sector, where she has litigated numerous patents covering pharmaceutical and biotechnological inventions and medical devices. Rebecca’s experience also covers a wide range of other technologies, including electronics, telecoms and engineering patents.
Alongside her patent litigation practice, Rebecca advises on biopharma regulatory issues, including litigation, advisory work and filing of applications for Supplementary Protection Certificates. Rebecca has also been involved in design right, anti-counterfeiting and lookalike matters for well known household brands. Where appropriate, Rebecca engages in the mediation of disputes.
Liaising with HMRC, Rebecca has successfully secured the detention of potentially infringing products (in relation to both patent and trade mark rights) at their point of entry into the UK, she has successfully negotiated the release of detained goods, and has managed portfolios of applications to HMRC for the registration of IP rights for border control purposes.
Rebecca has been praised in the legal directories for being “marvellous” and because she “takes an inventive approach to litigation and provides detailed analyses of the issues that go right to the heart of a case”. She is also “widely tipped for [her] artful coordination of cases with parallel actions taking place on foreign soil”.
Prior to joining Redd:
Acting for numerous clients in the pharmaceutical sector (including Krka and Consilient Health, Dr Reddy’s, Boehringer Ingelheim, Novartis, Pharmacia) before the High Court and Court of Appeal in disputes relating to infringement and validity of patents for pharmaceutical compounds, formulations and processes (immunosuppressants, ocular drugs, chemotherapy, respiratory drugs, antipsychotics, proton pump inhibitors).
Acting for Yeda before the UK Courts – up to and including the Supreme Court on an interlocutory issue – in a dispute as to patent entitlement (monoclonal antibody and anti-neoplastic agent combination therapy).
Acting for Yeda in proceedings before the CJEU relating to Supplementary Protection Certificates for combination products (monoclonal antibodies and anti-neoplastic agents).
Acting for Monsanto before the High Court and Court of Appeal in an action concerning the validity and infringement of biotechnology patents relating to genetically modified crops.
Acting for McGhan Medical before the High Court in a patent dispute relating to medical devices (breast implants).
Acting for Pfizer in an EPO opposition to a patent relating to ocular drugs.
Acting for Wobben (Enercon) in a patent dispute before the High Court against Siemens relating to wind turbine technology.
Acting for Rovi before the High Court in a multi-patent dispute against Virgin Media and TiVo relating to electronic programming guide technology.
Acting for HTC before the High Court and Court of Appeal in relation to patents for smartphone technology.
Acting for Easy Sanitairy Solutions in a patent dispute before the IP Enterprise Court concerning sanitaryware.
Acting for DeLonghi in a patent infringement and validity dispute concerning consumer goods.

Rebecca gained an MA degree in Biological Sciences (first class) from Oxford University. She trained as a solicitor (England & Wales) at Linklaters, qualifying into Linklaters’ Intellectual Property Department in January 2000. After moving to Bristows in August 2000, she obtained a Diploma in Intellectual Property Law & Practice from the University of Bristol. Rebecca moved to Powell Gilbert in 2007, becoming a partner there in 2008. She joined the partnership at Redd in 2015.
Rebecca is a member of the City of London Law Society IP Committee. She lectures, and writes, on aspects of intellectual property law.
